Public offer agreement

The text below is an agreement between the online store, whose website is located on the Internet at www.kozadereza.ua/uk/, hereinafter referred to as the “Online Store”, and the user of the services of the Online Store, hereinafter referred to as the “Buyer”, and defines the terms of purchase and sale of goods by the Buyer through the website of the Online Store.

1. General Provisions

1.1. This agreement is a public offer agreement (according to Articles 633, 641 and Chapter 63 of the Civil Code of Ukraine); its terms are identical for all buyers regardless of their status (individual, legal entity, or individual entrepreneur).

1.2. By accepting the terms of this agreement, i.e., the public offer of the Online Store, the user becomes the Buyer.

2. Terms and Definitions

2.1. Online Store – sole proprietor (FOP) Kolodiy Viktoriia Leonidivna, established in accordance with the legislation of Ukraine, who manages the website located on the Internet at www.kozadereza.ua/uk/.

2.2. Buyer – an individual who has reached eighteen years of age and receives information from the Online Store, places orders for searching, completing, and reserving Goods presented on the Online Store’s website for purposes not related to entrepreneurial activity, or a legal entity / individual entrepreneur.

2.3. Order – a completed and submitted request by the Buyer addressed to the Online Store for searching, completing, and reserving Goods for their subsequent purchase by the Buyer.

2.4. Website – a collection of pages accessible via a web browser, along with software modules unified by a single management system, located on the Internet at www.kozadereza.ua/uk/ and containing all characteristics of a public offer for searching, completing, and reserving Goods selected by the Buyer on the website.

2.8. Personal Account – a section of the Website accessible to the Buyer, which displays their personal information and the history of their placed Orders.

3. Subject of the Agreement

3.1. This agreement defines the procedure of interaction and the terms of sale of Goods by the Online Store to the Buyer, based on the Buyer’s intention, desire, and ability to search for, complete, and reserve Goods, as well as the Online Store’s desire to provide the necessary information, find and complete Goods according to the Buyer’s Order, and reserve them for further purchase by the Buyer.

3.2. The Online Store sells and delivers Goods using courier delivery services indicated on the Online Store’s website, based on Buyers’ requests submitted on the Website and confirmed by the Online Store. The prices for the Goods listed on the Website include the cost of searching, completing, reserving, and delivering the Goods to Buyers unless otherwise stated in the Order confirmation.

3.4. The Buyer agrees to the terms of this agreement at the time of placing the Order by clicking the “Confirm Order” button, which signifies the Buyer’s acknowledgment of having read this agreement and agreeing to its terms. Any subsequent objections by the Buyer regarding the consent provided in this manner release the Online Store from any responsibility for non-fulfillment of the terms of this agreement and entitle the Online Store to cancel the Order unilaterally.

4. Rules for Using the Website

4.1. The Buyer may browse the content of the Website, place orders, and use its other services.

4.2. Registration is required to provide the Buyer with access to personalized information and additional website features.

4.3. When registering, the Buyer enters the following data:

· First name, last name

· Phone number

· Email address

· Password

4.4. The Buyer undertakes to provide accurate, truthful, and complete information about themselves. The Online Store is not responsible for the accuracy of the information provided by the Buyer during registration and order placement.

4.5. After registering on the Website, the Buyer is granted access to the Personal Account.

4.6. The Buyer undertakes not to disclose access credentials specified during registration to third parties. If the Buyer suspects unauthorized use of their credentials by third parties, they must immediately notify the Online Store by sending an email to kozadereza.uk@gmail.com or contacting by phone at +380673505952.

4.7. The Buyer is responsible for any actions performed on the Website under their account and on their behalf.

4.8. The Online Store has the right to refuse service if it has grounds to believe that the Buyer provided inaccurate information or in cases of dishonest behavior (e.g., violation of this agreement, etc.).

4.9. It is prohibited to use the Website for illegal or prohibited activities. Buyers agree to comply with the laws of Ukraine and accepted Internet norms, including but not limited to refraining from posting extremist, pornographic, or other materials that infringe upon the honor, dignity, or business reputation of third parties, violate norms of morality, or posting advertising materials without the permission of the Online Store.

5. Order Placement Procedure

5.1. The Buyer places an Order independently on the Website by adding selected Goods to the virtual shopping cart and clicking the “Place Order” button.

5.2. Only registered buyers may place Orders for Goods.

6. Payment Procedure

6.1. The Buyer purchases the Goods specified in the Order placed on the Website and pays for the services of the Online Store under the conditions agreed upon in the Buyer’s Order confirmed by the Online Store:

- Prepayment to the Online Store’s bank account specified in the Order;

- Payment upon receipt of the Goods at the courier service’s office.

6.2. The total cost of the Order, which includes the full cost of the Goods and the Online Store’s services, equals the amount due for payment and is indicated on the Website during and at the moment of Order placement.

7. Return Policy

7.3. According to the law, goods of proper quality may be returned to the store within 14 days, provided that they have not been used.

8. Confidentiality and Personal Data Protection

8.1. Upon registering on the Website, the Buyer provides personal and contact data specified in paragraph 4.3 of this agreement, but not limited to it.

8.2. By providing personal data on the Website during registration or Order placement, the Buyer gives voluntary consent to the processing and use (including transfer) of their personal data without limitation of term, in accordance with the Law of Ukraine “On Personal Data Protection” dated 01.06.2010.

8.3. The Online Store uses received personal data for the purpose of selling goods defined by this agreement, including automated processing of personal data.

8.4. The Online Store undertakes not to disclose information received from the Buyer. Disclosure is not considered a violation if the information is provided to agents or third parties acting under an agreement with the Online Store, including for fulfilling obligations to the Buyer, or in cases required by law.

8.5. If the Buyer does not wish the Online Store to further process their personal data, they must submit a request to customer support. In this case, the Buyer will no longer be able to use the Online Store’s services.

8.6. The Buyer is responsible for keeping their personal data up to date. The Online Store is not responsible for improper service resulting from outdated or inaccurate Buyer information.

9. Informational Messages

9.1. By registering on the Website, the Buyer consents to receiving informational messages from the Online Store and its partners acting under agreements with the Online Store via SMS and email.

9.2. The Buyer may unsubscribe from such messages at any time by changing the appropriate settings in the Personal Account.

10. Rules for Using Materials Posted on the Website

10.1. The Website contains materials, trademarks, trade names, and other legally protected content, including but not limited to texts, photographs, graphics, musical and audio works.

10.2. All Website content is protected by the legislation of Ukraine.

10.3. The Buyer has no right to use the materials posted on the Website — modify, publish, transfer to third parties, participate in their sale or assignment, or create derivative works.

11. Other Conditions

11.1. This agreement is concluded on the territory of Ukraine and is governed by the substantive law of Ukraine.

11.2. Invalidity of any clause or part of this agreement does not invalidate the agreement as a whole.

11.3. All disputes arising between the Buyer and the Online Store shall be resolved through negotiations. If a dispute cannot be resolved, either party may apply to the courts in accordance with applicable law.

11.4. The Online Store may amend the text of this agreement at its own discretion at any time without prior notice to Buyers. The current (valid) version of the agreement is always available on the Website.
